AbstractThe reality of medieval violence is always linked to some kind of cruel exaggeration. For that reason, and to analyse the reality in a quantitative and qualitative way, it has been decided to investigate in this paper the transmission of the memory of the crimes (homicides, wounds, assaults, sexual crimes), as well as nuance the topic of criminal violence by demonstrating the late nature of the death penalty and the use of torture, much less common than economic compensation between individuals or representatives of justice in Galicia and northern Portugal during the Early Middle Ages. First, a period and territory will be defined (Galicia and Portugal between the 8th century and the end of the 11th century), to later observe the evidence of interpersonal violence transmitted mainly through the cartularies, as well as chronicles and hagiographies. Faced with the more abundant nature of the late medieval documentary news and references, the importance of qualitative news and how to deal with this type of information will be shown in this paper by a comparison with the rest of the documentary evidence whose objective was primarily to preserve properties, rights and granted donations. The integration of primary sources of social reality must be accompanied by a thorough study not only of the judicial system, but also of the totality of the disciplinary system, being it the Liber Iudicum or the canonical and penitential laws. Finally, it will be concluded after demonstrating the marginality and the almost non-existent of the death penalty in this period with the gradual change of the 12th century in relation to body composition and criminal of the end of High Middle Ages.
